Terms of Use

Welcome

Pushtimarg Satsang is a free devotional resource: a mobile app for iOS and Android, together with a companion website at pushtimargsatsang.com. It exists to serve the Vaishnav community by making Pushtimarg kirtans and paaths easy to find, read, and listen to, in Gujarati and English. These Terms of Use explain the basis on which the app and website are offered to you. They are written in plain English on purpose, but they are still a legal agreement, so please read them.

Throughout these terms, "we", "us", and "Pushtimarg Satsang" refer to the individual developer who builds and maintains the app and website. "The service" means the Pushtimarg Satsang app and the pushtimargsatsang.com website together.

1. Accepting these terms

By downloading, installing, or using the app, or by visiting the website, you agree to these terms. If you do not agree with them, please do not use the service. If you are using the service on behalf of someone else, for example helping an elder in your family, you confirm that you are able to accept these terms for that use.

2. What the service is

The service presents a library of Pushtimarg devotional content: kirtan and paath lyrics, titles, and audio recordings, in Gujarati and English. The app also offers audio playback, personal playlists, favourites, a festival (utsav) calendar, and optional local reminders for Ekadashi and utsavs. The website is a read-only companion that presents the same devotional library and calendar so that kirtans can be found through search engines and shared across devices.

There are no accounts, sign-ups, or logins anywhere on the service. Your playlists, favourites, and settings live on your own device.

3. The service is free

Pushtimarg Satsang is completely free. There are no purchases, no subscriptions, no in-app payments, and no advertising. It is offered as seva to the community, for personal, non-commercial devotional use.

4. Content, and its accuracy

The devotional content in the library (lyrics, titles, audio, and the utsav calendar) is maintained by the developer by hand and presented as-is. Reasonable care is taken, but with a library of this size, occasional errors are possible: a mistyped line, a mislabelled recording, or a calendar entry that needs correcting. The app includes a "Kirtan correction" option precisely so that you can point these out, and corrections from the community are genuinely welcomed.

The utsav calendar and reminders are offered as a helpful aid to your seva and observances. Dates and details may occasionally contain errors, so if an observance matters to you, please confirm it with your own trusted sources.

5. Using the service respectfully

We ask only what any reasonable person would expect. When using the app or website, you agree not to:

  • attempt to disrupt, damage, or interfere with the service or the systems behind it;
  • scrape or bulk-download the service in an abusive way, or place unreasonable load on it;
  • submit spam, or submit content you do not have the right to share;
  • use the service for anything unlawful, or in a way that harms others.

The service is provided for personal, non-commercial devotional use. Please do not repackage or resell it, or present its content as a commercial offering of your own.

6. Content you submit

The app lets you voluntarily submit content: you may offer a new kirtan to be considered for the library, or suggest a correction to existing content. Every submission is reviewed personally by the developer before anything is published. Submitting something does not guarantee it will be added or changed; decisions about what appears in the library rest with the developer.

By submitting content, you confirm that you have the right to share it, and you give Pushtimarg Satsang permission to publish, edit, format, and present that content within the app and website as part of the devotional library, without payment. This permission is what allows a submitted kirtan or correction to actually appear in the library and remain there. You keep whatever rights you hold in what you submit.

Please only submit content you are entitled to share. If you believe something in the library infringes your rights or has been shared without permission, please tell us through the Feedback option inside the Pushtimarg Satsang app and it will be looked into.

7. Intellectual property

The kirtans, paaths, and other devotional works presented in the service are traditional Pushtimarg devotional content, and the audio recordings and texts belong to their respective rights holders. Pushtimarg Satsang is a presentation and organisation layer for this heritage; it makes no claim of original authorship over the devotional works themselves.

The app's own design, source code, and the "Pushtimarg Satsang" name and branding belong to the developer. Please do not copy the app or website, or use the Pushtimarg Satsang name or branding, in a way that suggests your own product or service is ours.

8. Availability, and no warranties

The service is provided "as is" and "as available". Reasonable effort is made to keep it running, accurate, and useful, but as a free resource maintained by one person, it comes with no guarantees: we cannot promise it will always be available, uninterrupted, or error-free, or that any particular kirtan, recording, or feature will remain in the library permanently. Features may be changed, added, or withdrawn over time.

Nothing in this section affects any rights you have under the law of your country that cannot be excluded or limited by agreement. If you use the service as a consumer in the UK, nothing in these terms affects your statutory rights.

9. Limitation of liability

This section is written to be fair for what the service is: a free, non-commercial devotional resource offered by an individual, with nothing bought or sold.

We do not exclude or limit liability for anything that cannot lawfully be excluded or limited, including death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.

Subject to that, and to the fullest extent the law allows: because the service is provided free of charge, we are not liable for losses arising from your use of, or inability to use, the service, including losses caused by errors or omissions in the content, interruptions or discontinuation of the service, or reliance on the utsav calendar or reminders. We are in any case not liable for business losses; the service is intended for personal devotional use only.

In plain terms: we will always try to put right anything that has gone wrong, and the Feedback and correction options exist for exactly that, but a free devotional library cannot carry the kind of liability a paid commercial service might.

10. Changes to these terms

These terms may be updated from time to time, for example if the service gains a new feature or the law requires a change. When they change, the updated terms will be published on this page with a new effective date shown at the top. If you continue to use the app or website after a change takes effect, that continued use means you accept the updated terms. If a change is significant, reasonable effort will be made to make it noticeable.

11. Ending or changing the service

We hope Pushtimarg Satsang serves the community for a long time, but as a free service maintained by one developer, it may need to change, pause, or be discontinued, in whole or in part, at any time and without notice. We may also restrict or refuse access to anyone who misuses the service as described in section 5. You are free to stop using the service at any time simply by deleting the app; nothing in these terms binds you to keep using it.

12. General

If any part of these terms turns out to be invalid or unenforceable, the rest of the terms continue to apply. If we do not enforce a part of these terms on one occasion, that does not mean we have given up the right to enforce it later. These terms are between you and Pushtimarg Satsang, and no one else has rights under them.

13. Governing law and jurisdiction

These terms are governed by the law of England and Wales, and any dispute arising from them or from the service will be subject to the jurisdiction of the courts of England and Wales. If you live outside the UK, you may also have protections under the mandatory consumer laws of your own country, and nothing in these terms takes those away. If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.
